ARTICLE 1 - PURPOSE

This Distance Sales Contract regulates the rights and obligations of the parties regarding the goods ordered electronically from the SELLER's website by the BUYER in accordance with the provisions of the Law No. 6502 on Consumer Protection and the Distance Sales Regulation. The BUYER agrees to be informed about the following issues by examining the information on  https://www.3dmodeltrade.com/ before the establishment of this Agreement and before the order is placed and the payment obligation is assumed.

 ARTICLE 3 - CHARACTERISTICS OF THE PRODUCT SOLD AND PAYMENT TERMS

3.1. The BUYER accepts and declares that he / she has read and learned the basic qualities of the product, the sales price including taxes, the payment method and the information regarding delivery and that he / she has given the necessary confirmation in writing. The BUYER accepts and declares that he / she has obtained all the information required to be provided by the SELLER [firmaadi] in accordance with the Distance Selling Regulation before accepting this Agreement.

3.2. The qualities and quantity of the product purchased by the BUYER are the same as the information on the website at https://www.3dmodeltrade.com/ and on the invoice. After the product is sold, the order summary and the provisions of the sales contract are sent to the BUYER's e-mail address.

3.3. If there is an error in the product price due to system errors on the https://www.3dmodeltrade.com/ website, the BUYER is immediately informed. According to the BUYER's preference, either the transaction is canceled or the sales transaction is continued at the actual price of the product.

3.4. The product price and the exchange rate based on the payment may vary depending on the place of residence of the BUYER. The payment of the products purchased by the BUYER residing in Turkey shall be made in Turkish Lira at the Turkish Lira exchange rate, and the payment of the products purchased by the BUYER residing outside Turkey shall be made in Turkish Lira at the Euro and USD exchange rates. In the event that the BUYER uses VPN to change his/her residence and purchases the product, the SELLER reserves the right to cancel the sales transaction.

3.5. Payment by credit card can be made in a single installment or in more than one installment depending on the agreements made with the banks periodically. Installment and the interest that may occur later will be at the discretion of the relevant bank.

3.6. For the delivery of the product within the scope of the Sales Contract, the product price must be paid by the method preferred by the BUYER. In order for payments to be made by credit card, the BUYER must enter the credit card information completely in the payment field. If the product price is not paid or the payment is canceled by the bank, the SELLER may unilaterally terminate the sales contract and the SELLER's obligation to deliver the product to the BUYER disappears.

ARTICLE 4 - DELIVERY OF THE PRODUCT

4.1. Since the SELLER will be delivered digitally to the SELLER for the purchased product. It will be presented to the BUYER as a downloadable link from the server installed by the SELLER indefinitely. However, the SELLER may not be able to provide access to the products under the "DOWNLOADS" section on 3Dmodeltrade.com temporarily due to circumstances beyond its control, so it cannot be held responsible. If for any reason the link is not active or does not work within the period promised by the SELLER, the delay is notified to the BUYER and information is given about the stages of correction, if the BUYER cannot access the relevant document, this product is delivered to him by the SELLER, even by e-mail. After the detection of this error, the BUYER can also resolve the problem by warning the SELLER via [email protected] e-mail address.

4.2. The BUYER is obliged to immediately check the product at the time of delivery and immediately notify the SELLER of the defects, if any, by notifying the order number he ordered through the telephone number or e-mail addresses in the contact information above.

ARTICLE 5 - RIGHTS AND OBLIGATIONS OF THE SELLER AND THE BUYER

5.1 The SELLER is obliged to deliver the product subject to the Contract in accordance with the qualifications and specifications specified in the order, in full, complete and as a link that the BUYER can download indefinitely on the site as declared.

5.2. If no determination and notification is made within 10 days regarding the status of the downloadable product after the BUYER has made the product payment, the product received will be considered undamaged.

5.3. In the event that the delivery of the ordered product or service becomes impossible, the SELLER is obliged to notify the consumer in writing or by permanent data storage within three days from the date of learning of this situation and to refund all payments collected, including delivery expenses, if any, within fourteen days at the latest from the date of notification. If the product is not in stock, this will not be considered as unavailability of the product.

5.4 The SELLER shall enable the BUYER to re-download the product requested by the BUYER indefinitely as far as possible. However, if the BUYER has reached the purchased product once, it cannot refund the BUYER for subsequent downloads. The conditions necessary for the occurrence of a refund are listed under the relevant heading.

ARTICLE 6 - EXERCISE OF THE RIGHT OF WITHDRAWAL AND OBLIGATIONS OF THE PARTIES

Since the products that the SELLER provides service are products that do not have the right of withdrawal, the BUYER does not have the right to withdraw without giving a reasoned reason. Provided that it is not a product for which the right of withdrawal in Article 7 cannot be used, the BUYER may exercise the right of withdrawal by notifying the e-mail address or telephone number specified in Article 2 within 7 (seven) days with the reason for withdrawal.

In case of withdrawal, the price of the returned product shall be refunded using the original payment method of the BUYER within 14 (fourteen) days following the receipt of the product.

For returns made by credit card, the return period may vary according to the bank. The product to be returned must not have been downloaded / downloaded. Downloading the products in the Downloads link invalidates the right of return.

In case of withdrawal, if the returned product does not meet the return policy conditions, the product remains with the SELLER without any additional payment.

ARTICLE 7 PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

Products prepared for special occasions such as New Year's Day, Valentine's Day, Mother's/Father's Day and/or discounted products and products obtained from the "DOWNLOADS" link cannot be returned.

Since the SELLER provides digital product service, it is not possible to return the products under normal conditions.

ARTICLE 8 - DISPUTE RESOLUTION

Any disputes that may arise in relation to this Distance Sales Contract shall be resolved by the Consumer Arbitration Committees and Arbitration Courts in the place where the Buyer's residence is located and where the Product or Service is purchased by the Buyer, up to the value announced by the Ministry of Customs and Trade. Consumer claims will be decided by the district/provincial consumer arbitration committees in line with the lower and upper limits specified in paragraph 1 of Article 68 of the Law No. 6502 on Consumer Protection.

RETURN AND EXCHANGE POLICY

We take product quality issues very seriously and are always committed to resolving them to meet customer expectations. The claim must be sent to [email protected] within 7 days of purchase and must be based on one of the following reasons:

The product does not substantially match the description/preview images, (this does not apply when problems are caused by exchange format limitations and program version differences).

The product cannot be accessed from the link under the DOWNLOADS folder (This condition is realized after the SELLER is notified by the SELLER that the relevant file cannot be delivered to the BUYER).

The model was mixed with a physical/concrete object and the digital file was not downloaded.
